All requests under this section must be made in accordance with section 616.7 of this title, and all decisions will be made in accordance with that section. 6 NYCRR Part 598 – October 11, 2015 Page 2 of 35 Execution of 598.1 (g) (g). (1) Any person who violates any of the provisions of this Part, any instruction of the department or any order issued by the department shall bear the civil, administrative and criminal penalties specified in Article 71 of the Environmental Protection Law. (2) If any leakage of hazardous substances has occurred, is suspected or is likely to occur, the department may instruct the owner or operator to inspect any tank or related equipment that may be the source of such leakage, and test the tightness and structural reliability. If the Owner or the Operator fails to carry out such inspection and test within ten days after receiving the notice of such order, the Department may do so. The reasonable cost of such inspection and testing by the Authority shall be borne by the Owner or the Operator. (3) If the Owner or Operator fails to comply with these provisions, the Owner or Operator must conduct an on-site assessment under the guidance of the Department to determine whether there is evidence of release due to such non-compliance. The evaluation must be conducted in accordance with the requirements of Section 598.10 (e) of this part, and the results shall be submitted to the department within the time limit determined by the department. (h) The tank system will comply with these regulations in the future. Any existing tank system subject to these regulations in the future must comply with the requirements of this part within the specified period or within two years subject to these regulations, whichever is later.
This may occur if a substance is added to the list of hazardous substances in part 597 of this title. The installation of any new equipment must comply with the requirements of this part and part 599 of this title. (i) Review records and tank systems. Any designated officer or employee of the department shall have access in accordance with section 596.1 (e) of this title. (j) References.
