If the tank is ballasted during a flood warning, the tank valves and other openings must be closed and secured in the locked position before flooding occurs. (a) Transfer responsibility. Operators are responsible for transferring activities when they are on site or controlling the transfer of hazardous substances. If the operator is not on the premises and does not control the transfer of hazardous substances, the carrier shall be responsible for the transfer activities. The operator or carrier must take measures to prevent transshipment spillage, spillage and leakage. (b) Operational requirements. (1) Before and during the transfer, the operator or carrier must determine that the hazardous substance will be transferred to the appropriate tank, that the receiving tank has the available capacity to receive the quantity to be transferred, and that all tank valves and flow controls are in place to receive delivery.
